• Schlanger & Schlanger, LLP recently filed a lawsuit against Malen & Associates, PC and Portfolio Recovery Associates in federal court (Eastern District of New York), alleging that Malen & Portfolio sued a Brooklyn consumer on a debt that was outside the statute of limitations (i.e. “time-barred”) and filed legal papers in state court that, although signed by an attorney, were never meaningfully reviewed, in violation of the Fair Debt Collection Practices Act (FDCPA), New York General Business Law § 349, and New York Judiciary Law § 487 (Misconduct By Attorneys).  The consumer eventually settled with Portfolio Recovery, and the case against Malen & Associates remains pending.  Michael Diaz v. Portfolio Recovery Associates, LLC and Malen & Associates, P.C., 10-cv-07243 (S.D.N.Y. 2010).
